The various clauses in our Terms and Conditions are standard worldwide, the % fees we charge are not. The terms attached are in US Dollars and are indicative of our average margins. Unless otherwise agreed the terms and conditions attached on this page will be binding
1. Basic Terms
These Terms and Conditions of Business are between Global Solutions and the Employer/Client (hereinafter called the Client), and are deemed to be accepted by the Client by virtue of an interview or the employment of an application howsoever introduced by Global Solutions within a period of 12 months from the date of introduction.
(a) The Client agrees to notify Global Solutions immediately an applicant is accepted and to supply copies of all letters of offer to any applicant introduced to the Client by Global Solutions.
(b) The word ‘introduction’ means, for the avoidance of doubt, the presentation, by whatever means, of an applicant by Global Solutions to the Client for employment. This applies whether or not the Client knew of such an applicant previously or the applicant was known prior to introduction by the Client.
(c) All accounts and charges are payable immediately on receipt of invoice, and payment should be made to Global Solutions.
(d) Related sales taxes are payable in addition to our fees where applicable and will be charged at the prevailing rate.
2. Permanent Staff Terms
(a) Fees are calculated as a percentage of the first year’s gross remuneration, this includes all emoluments (including guaranteed bonus, superannuation and signing on fees ) . Company cars or car allowances shall be calculated at $12,000 USD and subsidised mortgages at $3,000 USD.
In the event of a guarantee or retainer for a period of less than 12 months, the fees shall be calculated on a pro rata basis as if the guarantee/retainer were for a period of 12 months. Fees shall be in accordance with the scale detailed below:
Minimum fee: $10,000 USD
Total Annual Salary: $0-$49,999 USD = 22.5%
Total Annual Salary: $50,000 plus USD = 25%
Fees for all candidates introduced to the Client from outside that clients offices or employed by the Client outside those offices will be subject to an additional, negotiable fee dependant on location and visa requirements.
(b) If the Client or a member of the Client’s staff refers a candidate introduced by Global Solutions to some other person or body, and the other person or body within 12 months of the introduction of the candidate engages that candidate in any capacity an introduction fee at our prevailing rates will apply.
(c) The fee will become payable upon commencement of the candidate’s engagement. Provided that the fees have been paid within 14 days of the candidate’s commencement of engagement, the following rebate scale will apply; if an applicant’s engagement with the Client is lawfully terminated for any reason other than redundancy, with the period specified (no trial periods allowed) and provided the Client informs us in writing of the fact within 7 days of termination, the Client will receive a rebate at the following rates:
1st week of employment 100%.
After the first week and before the end on the first Month: 75%
After the first month and before the end of the second month: 50%
Should an applicant leave the employment of the Client within the first week, then a minimum administration fee of $100 is payable to Global Solutions.
(d) It is also the Clients responsibility to obtain a work permit for the candidate wherever necessary.
(e) Global Solutions can accept no liability whatsoever on behalf of Clients, their servants or agents for any loss, damage, costs, or expenses howsoever caused which the Client may suffer or for which the Client may become liable rising out of or in connection with or as a result of introduction to the Client or the engagement by the Client of a candidate.
(f) If the client or any member of the clients staff engages employees of Global Solutions as staff in any capacity a flat introduction fee of $25,000 will be payable to Global Solutions. This applies whether that employee approached the client directly or otherwise.
(g) Ammendments to these terms and conditions can only be agreed by a director of Global Solutions. If unauthorized amendments are made Global Solutions will revert to the standard terms and conditions.
(h) In the event of an invoice being unpaid after a period of 60 days for any reason, Global Solutions reserves the right to revert back to our standard Terms and conditions where a discount has been agreed.
3. Advertised Assignment
Placement fees and Terms of Business for advertised assignments may be varied subject to the Client’s particular brief. Any difference to the general fee schedule and Terms of Business as laid out above will be agreed with the Client in writing prior to the commencement of the assignment. The Client is responsible for payment of all advertising costs at the agreed rate. All assignment expenses directly connected with the excise will be passed on at cost.
In signing this agreement it is deemed that both parties have read and understood the terms and conditions above and agree to be bound by them in their entirety. In the event that the contract is not signed by one or either party both parties will be bound by the contract if acceptance of it can be inferred by conduct.
